West Vancouver bans 'offensive' restaurant odours

VANCOUVER - West Vancouver council has unanimously passed a controversial bylaw that bans restaurant odours deemed offensive.
Under the bylaw, businesses that continue pumping out smells after being asked to stop can be fined up to $10,000.
The bylaw arose after complaints by some condo owners, who had been lobbying council for months over smells wafting from a nearby Persian restaurant.

Coun. Victor Durman said council agrees that strong odours from the Arian Restaurant have had a negative effect on their quality of life.
"This is not a frivolous matter," he said.
"This is where a smell invades a building and stays within a building and is continuous, and it becomes extremely annoying to people."
Ali Bakhtiari, who owns the Arian, said he's considering challenging the bylaw in court.
He estimated that installing a better ventilation system would cost $65,000.
In the past, he has said the smell issue is just the latest in a list of complaints from condo owners that range from how he disposes of garbage to how much noise his customers generate.
He has said he's being singled out, calling the complaints "unjust and racist."
Under the bylaw, only two people need to make a written complaint in order for municipal officers to consider imposing a fine.
The bylaw also applies to offensive noises such as loud ventilation fans.
